Trojans are not spamming. The messages being sent aren't confused with
spam. The old spammer excuse "Hacker X sent the spam advertising our web
site using our images and our IP" has been tried.
The ISP probably booted him because of all the complaints that he was
sending out virus to others. Your equipment, your responsibility to make
sure it's secure. Except for all the trouble it would bring, sometimes I
think the net needs something like an FCC to make sure the equipment
someone connects to the Internet doesn't interfere with or cause damage
to another operator's equipment, much the way the FCC regulates each
broadcaster's transmitter.
