I may not be able to get in, but i could make an attack on his system just
so he could report me to someone who would take no interest.

Generally ISPs and the police take portscanning pretty lightly, for example,
you cant get arrested for standing outside someones house examining thier
alarm system can you? 'casing the joint' as it were.
The majority of certianly UK ISPs will simply not take very much action on
the scanner at all, and you would simply be wasting your time.
