No, my understanding is that the recent court case involved an account
that had mail in the box but the user was prevented from getting to it.
In this example new mail kept coming in too. Now if you stop new mail
from coming in and allow the old mail to be retrieved then you should be
OK.
If the e-mail bounces then the sender will not have any reason to
believe that it was delivered and you are OK.
