Dan, entering a computer system in any jurisdiction in the U.S., after
being told to keep out, is criminal trespass. Many of the big providers
and a lot of the small ones, have configured their mail servers to
deliver an alternate message, which says something like "Spammers are
unwelcome here and are to keep out". That's all it takes to make the
act criminal in California and in other states as well.
Whether the district attorney will do anything about it is another issue
entirely.
