You can argue that it's valid but that doesn't change the law. I suggest you
read over the Digital Millennium Copyright Act. I don't think you'll find
that your proposed commercial use of their software would be considered
"Fair Use" under the law.

First, Dan's right in that "valid" has nothing to do with "legal."
But Dan, he did specify "for debugging purposes" so I'm not sure what you
mean by "proposed commercial use".
