Thing is, port scanners are not just used as an ATTACK tool. They can
be extremely useful as a DEFENSIVE tool. ie. checking what ports are visible
in a subnet you are responsible. I use one called nmap frequently for this
purpose.

And yes it may be an offense in the UK to be in possesion of tools that
can only be used for burglary. However, it is not an offense while standing
on public property to look at the exterior of a building using binoculars.
