RE: [cobalt-users] Problems w/ Cobaltracks.com



OK another point I missed on my last email. At no time has Cobalt Racks
given me a copy of their terms and conditions, and/or contract. I have
emailed support, Sam and sales to get a copy of the T&C and contract to no
avail. Are they trying to cover their own backs?

Though IANAL, I thought you might look at this train of thought:

Is there anything in their contract about service being down?

Depending on what their contract says or doesn't say, if they're down
below industry standards (I'd guess somewhere around 99% - 99.9% per
month) and depending on how much they too their own horn on their
website (as far as connectivity and speed is concerned), then they've
probably already broken the contract and won't fight your attorney's
letter pointing that out.  You may not get your money back, but life
does go on.
