OpenSSH (at least the one compiled and packaged by me) does not contain ANY
RSA code but uses different (better) algorithms

No. RSA Security, Inc. holds the patent (singular) on the RSA
algorithm. Data Fellows has a license for the patent.

You can't create something from "patent free source", as a patent covers
an idea, not an implementation. The RSA algorithm is patented, and any
code that implements it infringes on that patent unless it is licensed
by RSA.
The OpenSSL libraries contain an implementation of the RSA algorithm, so
unless you have a license, you are infringing on RSA's patent.
However, this is only true for another 31 days: the RSA patent expires
September 20.
