You are NOT responsible. However, as a good netizen, your TOS should
allow you to terminate a customer who uses spam to direct customers to a
site hosted on your system, or with a return address on your system.
Then, when this comes to your attention, you simply change his password,
redirect his site to a page that says "Temporarily Unavailable", and sue
him for damages. You do comply with the details of California law so
you can sue him for damages, right <wry grin>?

If it's directing customers to his business, he's doing it. Unless
someone else is spending money to advertise him <wry grin>.
