Since your server is private property, you can prohibit anything you like.
No one has to agree with your terms, they can just go elsewhere. Many ISPs
won't host sites that promote or sell tobacco products or firearms as well.
You can refuse to host sites that sell software with the primary purpose of
sending unsolicited email. Such software is illegal in the state of
Virginia.

transmit, promote, or otherwise make available any software, product or
service that is illegal, violates the rights of Erols or a third party, or
is designed to violate this Agreement. Such software, products or services

advertisements (i.e. "spamware"), services which send unsolicited
advertisements, programs designed to initiate "denial of service" attacks,
mail bomb programs, and programs designed to gain unauthorized access to
networks on the Internet."
