The main reason I WON'T consider their product is that they want to decide how I should run my business:
You may NOT however, havetwo sets of hosting plans - one set for e-commerce sites and one for regular sites. If you elect to use the upgrade incentive program, In The Q must be available on ALL hosting plans other than your lowest priced plan. No exceptions.

To answer your question, yes - that would void the license.
Sorry, but I thought I got to decide how to run my business. Since the only decision I can make is not to use the product, that's the decision I have to go with.
I'll soon be offering MIVA to my customers included in a reasonably-priced eCommerce hosting solution, with NO upfront charge for the software. 

(I may be able to offer it for resellers, as well.)
