It is my understanding, that even in Australia as in the US, it is
completely dependent on your contract with the customer and there are no
laws regarding what an ISP may or may not block. I would certainly like
to see a link to an Australian law stating otherwise. I know where to
find the US law that exempts ISPs from liability for any good faith
effort to block spam and it can be easily googled.
