It would be best to correct your formmail.
If not possible I would suggest to reduce the two checks down to 2.4 grade.
In total you would have 4.8 which is ok for your setting to not be marked.
For all other "real" spam which comes to you with these Msgid and/or
Buggy_cgi they are still checked but have only 2.4 instead of 2.6 or 3.3.
This should help additionally identify them as spam.
