Chances are they have a worm and are an open proxy/relay for spam.

What test case? You said they are exposed for liability. That would
require a court ruling or law to that effect.

I have and my former web host was listed and I do understand. The
problem is spam and spammers and the ISPs that harbor them, not DNSBLs
and blacklists.

No, but if you were speaking and said Nassau while talking about the
space shuttle when you meant to say NASA people would also understand
what you were saying.
