Who says you are liable for the data on your server?  If you are, then I'd re-evaluate your TOS.

Customers are ALWAYS liable for their own data with large hosting companies such as verio etc, why would you set your company up to be trashed by a hard drive failure, act of god or other uncontrollable event?
