Yeah, but doesn't the ISP have something in their _own_ T&C that
prohibits unsolicited bulk emailing?  If not, that ISP is just asking
for spammers to sign up...

I haven't seen any legit ISP/hosting company/etc that doesn't have a
'no spam or we yank you' clause in the fine print.

No argument here. I read the law that was posted and commented on it. It says they can sue if they are in violation of their rules. If they post them on their web site, that is enough. But it doesn't say they can shut them down.
