Those clauses completely disregard the Sherman antitrust act and my guess is
that there will be some large legal judgments against the upstream providers
this year.

Yeah, but doesn't the ISP have something in their _own_ T&C that
prohibits unsolicited bulk emailing? If not, that ISP is just asking
for spammers to sign up...
I haven't seen any legit ISP/hosting company/etc that doesn't have a
'no spam or we yank you' clause in the fine print.
