actually, portscan, because it seeks to elicit a response, is technically
accessing the remote commuter. I would say it is more like rattling a
doorknob instead of pushing the bell or knocking. If it opens, and you look
in at anything, an aggressive DA could prosecute you for unlawful entry.
If your service provider does it, it may be covered in a contract paragraph.
If I do it, I could be prosecuted. I once got fired because I was at a desk
in the office, my foot noted the safe was open, and when I looked down, I
was noticed. Never did anything but note it, and I was persecuted for
looking.
