No.  You can supply them with appropriate log entries which they can use
to build a case.  If you do this without a court order (depending on
your jurisdiction) you could find yourself either sued for invasion of
privacy, or jailed.

If you do get the court order you can charge them for the time it takes
to separate out that one employee's email from the logs if you can
identify it.  If you can't identify it you have to be very careful.  You
must not (again this may vary by jurisdictions) exceed the scope of the
court order, or else other people can and will sue you for invasion of
privacy.

Yes.  The U.S. Federal Bureau of Investigation has one.  It's called
(reasonably enough <wry grin>) "Carnivore" and it's extremely
controversial.  You should be very happy that they haven't asked to put
one into your pipe yet (of course they may have put one in upstream of
you <frown>).
