Sun should get involved - how many considered the original posting SPAM? Not I - but obviously ENOUGH to start a ridiculously long thread about whether it was, or was not SPAM....
A perfectly reasonable solution would be to create a new list, which DID allow advertising and the offers by reasonable people of their used (and perhaps new) Cobalt RAQ / Cube / CacheRAQ products and services.
The problems arise when there is ambiguity - which in this case there obviously is. In the event of arbitration, it would be fairer to call the matter closed - re-publish the list of rules, amended if need be - and start the new list for ads as soon as practical.
That said - I personally wasn't offended by the posting - although I sympathize with those that were - up to the point where they start appointing themselves as list guardians - you aren't! If you have a beef with a posting, do one or more of the following:
1. complain to the list and shut up
2. complain OFF LIST to the poster
3. remind (politely) that ads aren't appreciated by all/any - whichever the list permits
4. repost list rules
5. complain to the list owner(s) - in this case Sun/Cobalt
6. complain upstream to the poster's providers - this should ONLY be considered after all other warnings, pleadings, etc, and all other avenues of complaint have been exhausted, or when the poster consistently flouts the published (and well known) rules of the group.
You can't reasonably expect to jump right to step 6 unless you are the list owner - doing so makes you a tattle tail and a sad individual.
