I had a similer problem when I ran y Plumbing & heating business, I
installed a bathroom and the client didn't sign my contract although paid
the deposit, and would not pay the final invoice as quoted, when it got to
court the judge said that although the contract wasn't signed by sending the
deposit check which was specified in the quote he would be liable to pay the
bill, and as you had recieved the contract back with a cheque, he was
agreeing with the original quotation and terms. SO if you was me I would
either sue him, or delete the site and put it down to the server got hacked
and all sites where lost, and the only one you didn't backup as his because
he didn't pay, and you wouldn't waste any more time in backing up the site
for a none paying client, OR move his site to another directory and build a
new him page for him saying SORRY THIS COMPANY HAS GONE BANCRUPT and insert
the clients details, You will soon get a phone call, I'm sure.

I've been following this topic as I have a really nasty mess with a client.
He put a down payment for hosting, development, etc. and then has been
avoiding paying the rest or even communicating about it. I'm not only out
hosting fees, but actual cash for contracted Flash work and multiple domain
names registered for this guy.   I went to pull up his contract and (Yikes!)
he returned it unsigned with his initial check.
I would appreciate any (helpful) thoughts.
