It is truly an area with a huge amount of gray.

I cannot tell wether the british codes of law know any rules applicable on
portscanning but according to martial law you will have to produce evidence
that this portscanning was done with a harmful purpose in order to damage
anything because the court will ask for the committer's intention. And this
point will be a problem as long as the did not occur any loss.

Or did you have any loss?
