Yes, you can actually. If it can be "proven" that he did something with the
intent of doing something illegal - it can be prosecuted.

(think of the police findings the notes planning a bank robbery in your
apartment -- can  you then say that it's just something you made "for fun"?)

Anyways, court cases has been ruled on the subject. The trouble is, that
more or less each country has it's own set of regulations and precedences on
the subject.
