Depending on what state you live in, there are various computer laws. One
of such in Virginia that deals directly with Computer Trespass. The code
section is 18.2-152.4 (Computer Trespass) This code spells out the
punishment and level of seriousness due to the damage. It can be from a
class 3 misdemeanor to a class 6 felony.
I have links below to the several laws that have been passed recently
regarding the hacking, trespassing, unauthorized use of a server to forward
Spam and so on. I am sure that other states have laws regarding this. It
would fall under your state code even if the hacker lives in another
state/country (depending on where your server may be located).

These laws again pertain to Virginia. You can check at www.findlaw.com to
gain a link to your respective state code sections and search for computer
related laws. I am not sure that you would want to go this far, however the
laws are there. If they are enforced then some will get the message.

Hey everyone, just a note to let you know about a malicious User from
symaptico.ca.
I received an alarm on my firewall, a user tried to use a netbus Trojan to
bring down the server. Probably an ICMP flood. Anyway, I got the log and Ip
address of the user. Did a nslookup on the address and then a whois on the
domain. Called the phone # on the Whois record and spoke with their admin,
who said send a message to abuse@xxxxxxxxxxxx and they would take care of
it.
My question is what right do I have at this point?
