The same way that Red Hat was able to sell it in a box down at Fry's...

They paid royalties.  Or they bought the code from someone who did.

I, and a lot of other people, have had SSL servers for some time.  The
difference is that now we can use openSSL and other open solutions
without paying royalties.  In the past I always bought Red Hat
Professional (one box for each system was required for the Secure
Server).
