Well, you can certainly get them on copyright infringement, if they aren't
licensed to use your intellectual property.

Also, you can play a nasty trick on him if you'd like them to learn a
lesson.

Copy the image that he is using directly off of your server to a new file.
Make all the pages on the site that need to reference that image reference
the new copy.  Then replace the existing copy of the image with something
like a huge "(C) 2000 Mike Fritsch, use of this image without a license is
prohibited by law.".  I think that'd snap him into compliance, especially if
it was on his order screen.

Depending on how far down your relationship has gone, you would also be
within your bounds to request damages.
