Since no lawyer in his right mind would take this case any other way.

Copyright?  Your copyright is on your content, and only your content; 
not on the footers presented on the list.

Fraud?  Who is being defrauded?  Are you somehow being defrauded by 
being pointed to the archives currently holding the list?  Or by being 
told how to subscribe to the list at it's current home?

Mis-representation? It's more misrepresentation to save incorrect 
information in the archives.

Sun could sue, if they wanted to do so, but they wouldn't win 
automatically; only if they outspent whoever they were suing and the 
defendant had to throw in the towel before the judge threw it out.

You couldn't even sue except for your own posts, and it's hard to 
believe you'd win even for them.

Nevertheless, If asked I'd advise Bruce, Ryan and others to cut your 
posts out of the archives.  It's easy enough to do.
