This is fixed in kernels ca. 2.2.14C3 and higher (CVS says since 
"Thu Mar 9 02:08:02 2000").

kernel 2.2.14C10 (including this fix, I'd assume :) is in the All-Kernel
i386
update, available on our web site.  The driver maintainer and I have
been in contact about what the "right" fix for this race issue is.
